BurrowTV and all platforms associated with "Burrow" or "Burrow TV" are private media platforms operated by Shield of Souls Assembly, providing access to video content for educational, informational, and archival purposes. These Terms of Service ("Terms") govern your access to and use of BurrowTV's services, website, and platform (collectively, the "Service").
MANDATORY ACCEPTANCE REQUIREMENT: Upon your first access to this platform, you MUST affirmatively accept these Terms by clicking "Accept Terms and Conditions" before gaining access to the Service. Your initial acceptance creates a permanent, binding contract.
BINDING AGREEMENT NOTICE: BY CLICKING "ACCEPT TERMS AND CONDITIONS," ACCESSING, VIEWING, OR USING ANY PART OF THIS WEBSITE OR SERVICE, YOU AUTOMATICALLY AND IMMEDIATELY AGREE TO BE LEGALLY BOUND BY THESE TERMS IN THEIR ENTIRETY, INCLUDING ALL FINANCIAL PENALTIES AND LEGAL CONSEQUENCES DESCRIBED HEREIN, FOR ALL TIME. BurrowTV Entity Status: BurrowTV ("Burrow" or "Burrow TV") operates as a distinct member entity within the Shield of Souls Assembly, created by a member of the Assembly and consecrated to the service of truth-seeking and the betterment of fellow souls. Relationship to Assembly: BurrowTV exists as a member entity of Shield of Souls Assembly, reflecting the same foundational values, natural law principles, and spiritual mission of service to humanity.
Stewardship Model: BurrowTV operates under a stewardship model consistent with natural law and biblical principles, wherein the platform serves as a "bondservant" or "minister" (in the original sense of servant/helper) to the community, represented by and through Shield of Souls Assembly.
Legal Representation: For purposes of legal proceedings, contractual matters, or any litigation, Shield of Souls Assembly serves as the legal representative and, where secular legal frameworks require formal "ownership" designation, may be recognized as holding such title. This designation exists solely to satisfy secular legal requirements and does not diminish the spiritual and natural law foundations of the stewardship relationship.
Purpose and Mission: BurrowTV's purpose is service to humanity through truth-sharing, education, and the betterment of souls—not commercial gain or profit. This mission is inseparable from Shield of Souls Assembly's broader mission of spiritual service, natural law advocacy, and community support.
No Commercial Motive: BurrowTV does not exist for monetary profit, advertising revenue, or data commercialization. Any revenue generated supports operational costs and furthers the mission of service.
"Platform" or "Service" means BurrowTV and all platforms associated with "Burrow" or "Burrow TV", including all associated websites, applications, software, and services provided by Shield of Souls Assembly.
"Content" means all video, audio, text, images, graphics, and other materials available through the Service, including but not limited to documentaries, educational materials, and archival footage. All Content is created, curated, and owned by Shield of Souls Assembly as expressions of free speech and artistic expression.
"User", "You", or "Your" means any individual or entity accessing, viewing, or using the Service in any manner.
"Community Member" means any individual who has created an account on BurrowTV, thereby becoming a member of Shield of Souls Assembly at a participatory level. Upon account creation, you become a Community Member with all associated rights and responsibilities within the private membership association.
"Operator", "We", "Us", or "Our" means Shield of Souls Assembly and its authorized representatives.
"Account" means a registered user profile created to access certain features of the Service.
"Personal Information" means any information that identifies or can be used to identify an individual user.
"Premium Features" means enhanced platform functionality, social media features, chat services, payment processing, and other services that may require fees, separate from free video viewing.
Shield of Souls Assembly and BurrowTV operate under natural law, constitutional protections, and private contract principles. We are not federal corporations, do not engage in interstate commerce as defined by federal statute, and do not operate under Federal Trade Commission (FTC) jurisdiction. Our activities constitute protected First Amendment assembly, speech, and religious exercise.
We explicitly deny FTC jurisdiction and any other federal agency jurisdiction without proof of explicit consent, which has not been granted. Any federal agency claiming jurisdiction must prove such jurisdiction exists through the mechanisms described in Section 2.4 below.

The Operator asserts jurisdiction over this Service based on the following principles:

BINDING AGREEMENT UPON CONTACT:
By contacting Shield of Souls Assembly or BurrowTV in any official capacity, any federal agency representative (including but not limited to FTC, FBI, DHS, ICE, or any other federal entity) automatically agrees to provide the following information under penalty of perjury BEFORE we are obligated to respond, cooperate, or acknowledge jurisdiction.
Your initial contact constitutes acceptance of these terms. We are under no obligation to respond, cooperate, or acknowledge jurisdiction until you provide complete satisfactory answers to all ten questions.
TEN REQUIRED QUESTIONS FOR JURISDICTIONAL CLAIMS:
Any federal agency claiming jurisdiction must provide written responses under penalty of perjury to the following:
1. Proof of Specific Harm to Identified Victim - Identify the harmed individual by full legal name - Describe the specific nature of the injury with evidence of damages - Explain how jurisdiction is established (Article III Section 2 requires actual controversy involving identified parties with standing)
2. Specific Statutory Authority - Cite the specific statute granting your agency jurisdiction over private unincorporated assemblies exercising First Amendment rights - Quote the relevant statutory text explaining its application to non-commercial ministry and educational activity - Prove the cited statute does not violate First Amendment, Ninth Amendment, or Tenth Amendment protections

Individual with Firsthand Knowledge - Identify the living person (not agency or office) making this jurisdictional claim - Provide the name, title, and acknowledgment of personal commercial liability of the individual - Explain how an administrative agency (artificial entity) can have "firsthand knowledge" when only living men and women can have direct sensory experience
6. Bond Number and Bonding Information - Provide the bond number of the individual official making this claim - Provide the name of the bonding company - Confirm the bond is active and in good standing - All government officials must be bonded to protect against abuse of authority; this information establishes the pathway for personal commercial liability claims
7. Written Affirmation of Knowledge and Intent
The individual official must provide written affirmation under penalty of perjury that they understand and acknowledge:
A) Shield of Souls Assembly and BurrowTV operate as a private assembly under natural law and First Amendment protections
B) Asserting jurisdiction without proof of explicit consent constitutes a violation of natural rights and abuse of authority under 18 USC §242 (Deprivation of Rights Under Color of Law)
C) Making false jurisdictional claims subjects the individual official to personal commercial liability through their bond
D) The individual is acting with full knowledge of these consequences and accepts full personal and commercial liability for their actions
E) Proceeding after receiving explicit notice of these conditions waives any claim to qualified immunity or good faith defense
8. Constitutional Authority for Regulating Speech, Assembly, and Religious Practice - Explain how your agency's regulatory actions do not violate the First Amendment's absolute prohibition on government interference with speech, assembly, and religious exercise - Address how the commercial speech doctrine applies (or does not apply) to non-commercial ministry and educational activities - Explain whether administrative agencies have authority to determine what constitutes "protected" versus "unprotected" speech
9. Compelling Government Interest Under Strict Scrutiny - Identify the specific compelling government interest justifying regulatory action - Explain why less restrictive means of achieving this interest are unavailable - Prove the proposed enforcement action is narrowly tailored to achieve only the identified compelling interest
10. Due Diligence Documentation - Provide documentation proving your agency investigated and confirmed that Shield of Souls Assembly/BurrowTV is NOT engaged in interstate commerce as defined by federal statute - Document evidence that we are NOT operating as a federal corporation - Show evidence that we are NOT accepting federal benefits, licenses, or registrations that would create voluntary jurisdiction - Prove your agency conducted due diligence distinguishing private assembly activity from regulable commercial activity
FAILURE TO PROVIDE COMPLETE RESPONSE:
Failure to provide complete, satisfactory written responses to all ten questions under penalty of perjury within thirty (30) days of your initial contact constitutes:
Admission of Lack of Jurisdiction: Your agency's inability or unwillingness to answer demonstrates lack of legitimate jurisdictional basis
Waiver of Authority Claims: Failure to meet these conditions waives any claim to authority over our operations
Basis for Bond Claim: Creates grounds for filing claim against the individual official's bond for acting without proper authority
Evidence for Civil Rights Lawsuit: Provides basis for action under 42 USC §1983 for deprivation of rights under color of law
Bad Faith Evidence: Establishes bad faith for purposes of punitive damages and attorney fee awards
FRAUDULENT ADMINISTRATIVE REMEDY CLAIMS:
If you fail to provide the required information and we do not respond, you may NOT subsequently claim that you "exhausted administrative remedies" or that our non-response constitutes admission, default, or grounds for judicial relief.
Any attempt to proceed to litigation claiming you properly notified us when you actually submitted deficient notice constitutes fraud on the court and subjects your agency and individual officials to: - Counter-suit for fraudulent misrepresentation - Claims for abuse of process - Vexatious litigation damages - Personal liability under bond - All attorney fees and costs - Sanctions for bad faith litigation tactics
We will aggressively pursue all available remedies against any party attempting this tactic.
These Terms do not and cannot: - Override constitutional protections or natural rights - Create obligations beyond those voluntarily assumed - Waive rights that are unwaiveable under natural law or constitutional principles - Establish jurisdiction over users in matters unrelated to Service access
BurrowTV operates as a Private Member Educational Archive and Anti-Censorship Expression Platform.
This platform is protected under multiple layers of constitutional protections:

First Amendment SPEECH: All content represents Shield of Souls Assembly's curated expression, editorial judgment, and protected opinion on what information is important and worthy of preservation

No User-Uploaded Content: Users may communicate via text chat only (when implemented). All video content, documentaries, and media are Shield of Souls Assembly's curated collection and protected expression. This eliminates platform liability for third-party content.

Future Revenue Model: The platform will implement the following revenue streams to support operations and the humanitarian mission of Shield of Souls Assembly:

Any fees charged are exclusively for the labor required to maintain premium platform features, services, and functionality - never for access to video content itself. When you contribute toward features like database access, user accounts, chat, or comments, you are compensating for the work required to build, maintain, and secure those systems, not for content. This ensures no claim can be made regarding sale of third-party materials, as all video content is Shield of Souls Assembly's original expression and curation provided free of charge.

NOTICE TO PAYMENT PROCESSORS AND FINANCIAL INSTITUTIONS:
All payments are processed through a member-operated LLC that is a separate business entity and Assembly member. BurrowTV receives NO direct payments from users. Any attempt to characterize donations or contributions to the member-operated LLC as payments directly to BurrowTV constitutes intentional misrepresentation of business relationships.
By processing payments, you acknowledge: 1. Payments are to the member-operated LLC, not BurrowTV 2. Any claim connecting payments directly to BurrowTV is knowingly false 3. Retaliation based on false connection subjects you to liability for: - Business interference damages - Defamation of business operations - Breach of merchant agreement - Violation of fair dealing obligations - Tortious interference with Assembly operations
Before taking adverse action against any member business, payment processor must provide under penalty of perjury: 1. Evidence the member business violated a specific merchant agreement term (cite exact term and evidence of violation) 2. Proof that payments were TO BurrowTV rather than to the member business (impossible to prove as factually false) 3. Identification of the individual making the adverse action decision with bond number 4. Acknowledgment of personal liability for false claims and misrepresentation
Fraudulent Retaliation Consequences: If you take adverse action based on intentional misrepresentation that the member business and BurrowTV are the same entity, or that payments to member business equal payments to BurrowTV, you will be subject to immediate legal action for knowing misrepresentation, defamation, and tortious interference with lawful business operations.
We will aggressively counter-sue any party attempting financial retaliation based on false characterization of business relationships.
Shield of Souls Assembly and BurrowTV operate outside commercial jurisdiction. Our relationship with Community Members is NOT a commercial transaction subject to the Uniform Commercial Code (UCC) or Federal Trade Commission oversight. This is private membership association activity protected under First Amendment assembly rights.
However, to the extent any party attempts to characterize our operations as commercial, we explicitly preserve all rights and remedies under:
Trust Law Framework: We recognize that birth certificates and similar documents create legal fictions separate from natural persons. Community Members are living beings with natural rights, not legal fictions or statutory "consumers." The legal entity versus natural person distinction prevents commercial jurisdiction presumptions.
Duress Principle: Any compliance under threat of platform shutdown, regulatory action, or financial pressure constitutes duress and does not establish valid consent to jurisdiction or commercial relationship.
No Consideration = No Valid Contract: If any agency demands compliance with commercial regulations, they must demonstrate what consideration THEY are providing in exchange. Absence of consideration means no valid commercial relationship exists.
Any attempt to impose commercial jurisdiction requires satisfying the Conditional Acceptance requirements in Section 2.4. Commercial presumptions are explicitly rebutted. We operate under private membership covenant, not commercial code.
As a user of BurrowTV, you have the following rights:
Right to Access: Subject to these Terms, you have the right to access and view Content available on the platform.
Right to Privacy: Your Personal Information will be protected in accordance with our Privacy Policy and applicable law.

Since video content viewing is always free and the platform does not charge for Content access, no claim can be made that Shield of Souls Assembly is selling third-party materials. The Content archive is Shield of Souls Assembly's original expression and curation, protected as free speech.
The entirety of the archive on BurrowTV, taken as a whole, constitutes an expression of Truth and Shield of Souls Assembly's protected speech. The complete collection, in its entirety, is asserted to fall under the Fair Use doctrine for the following purposes:

This covenant does NOT violate your First Amendment rights because: 1. Shield of Souls Assembly is a private entity, not a government actor 2. You are voluntarily agreeing to this restriction 3. You receive valuable consideration (free access to platform and content) 4. You can decline by simply not using the Service 5. The restriction is limited in scope to statements about this specific platform
You remain free to express any opinion about any other topic. You simply agree not to publicly attack this specific platform that you voluntarily chose to access.
If you violate this covenant by making prohibited disparaging statements:
Cease and Desist: Shield of Souls Assembly will issue written demand that you immediately remove, retract, or delete the disparaging content.
Compliance Period: You will have 72 hours from receipt of notice to fully comply by:

Therefore, the parties agree to the following liquidated damages provisions as a reasonable estimate of actual damages that would result from breach, NOT as a penalty.
Upon violation of Section 13.3 or Section 14 (Anti-Disparagement Covenant), you agree to pay Shield of Souls Assembly liquidated damages as follows:
TIER 1 - Initial Violation: - $50,000 for first violation of anti-disparagement covenant - Applies to first instance of prohibited negative review, disparaging statement, or harmful publication
TIER 2 - Continued Violation: - $100,000 for failure to remove disparaging content within 72 hours of cease and desist notice - Applies if you refuse to comply with removal demand
TIER 3 - Repeated Violations: - $250,000 for each additional violation after the first - Applies to each separate instance of prohibited conduct (each post, review, video, article, etc.)
TIER 4 - Coordinated Attacks: - $500,000 for organizing, coordinating, or leading coordinated attacks, review brigading, or harassment campaigns against the platform
TIER 5 - Willful and Malicious Conduct: - $1,000,000 for willful, malicious, or intentional violations designed to cause maximum harm - Applies when evidence shows deliberate intent to destroy platform reputation or operations
In addition to liquidated damages, Shield of Souls Assembly reserves the right to pursue:

Consent to Judgment: You consent to entry of judgment against you for liquidated damages upon proof of violation.

Payment of liquidated damages is the MINIMUM consequence, not a "buyout" of your obligations.
Shield of Souls Assembly's Position:
We provide FREE access to video content. We ask for NOTHING except that you not use that free access to publicly attack us.
If you don't like what we're doing: mind your own business and don't use the Service.
But if you choose to access our platform (for free) and then use that access to publicly disparage us, we will not be victims. We will enforce this contract to the fullest extent of the law.
We will not tolerate: - Being attacked for providing free speech platform - Being trampled on by those who hate truth - Being silenced or shut down by coordinated campaigns - Allowing our mission to be undermined by bad-faith actors
We will take everything you have if you breach this covenant, refuse to comply with removal demands, and force us into litigation. This is more than reasonable given that you received free access and voluntarily agreed to these Terms.
